It summarises the exchange which focused on Harriet Wistrich’s career trajectory and the many public interest law cases that she has brought on behalf her clients, mainly women, in both domestic and international forums. When communal sharing relationships suddenly intensify, people experience an emotion that English speakers may label, depending on context, “moved,” “touched,” “heart-warming,” “nostalgia,” “patriotism,” or “rapture”. We call the emotion kama muta. Kama muta evokes adaptive motives to devote and commit to the CSRs that are fundamental to social life. It occurs in diverse contexts and appears to be pervasive across cultures and throughout history, while people experience it with reference to its cultural and contextual meanings. Cultures have evolved diverse practices, (...) institutions, roles, narratives, arts, and artifacts whose core function is to evoke kama muta. Kama muta mediates much of human sociality. (shrink)

What is the nature of the social sciences? What kinds of knowledge can they—and should they—hope to create? Are objective viewpoints possible and can universal laws be discovered? Questions like these have been asked with increasing urgency in recent years, as some philosophers and researchers have perceived a "crisis" in the social sciences. Metatheory in Social Science offers many provocative arguments and analyses of basic conceptual frameworks for the study of human behavior. These are offered primarily by practicing researchers and (...) are related to problems in disciplines as diverse as sociology, psychology, psychiatry, anthropology, and philosophy of science. While various points of view are expressed in these nineteen essays, they have in common several themes, including the comparison of social and natural science, the role of knowledge in meeting the demands of society and its pressing problems, and the nature and role of subjectivity in science. Some authors hold that subjectivity cannot be studied scientifically; others argue that it can and must be if progress in knowledge is to be made. The essays demonstrate the philosophical pluralism they discuss and give a wide range of alternative positions on the future of the social and behavioral sciences in a postpositivist intellectual world. All authors in this symposium use a food regime perspective to ask questions about the present which—as these articles demonstrate—have several possible answers. History suggests a time perspective of 25–40 year cycles so far—a food regime 1870–1914, an experimental and chaotic era 1914–1947, and a food regime 1947–1973. It has been less than 40 years since 1973, when food regime analysts agree that a contested and experimental period began. There is no consensus on whether it has already ended or how (...) it might issue into a new food regime. The conversation is more fruitful than the conclusions. In an important and timely book, Anneli Jefferson outlines a view according to which a given mental disorder is a brain disorder if it is a (harmful) mental dysfunction realised by a brain dysfunction. Prima facie, Jefferson’s book is a study in the metaphysics of dysfunction: how does mental dysfunction relate to brain dysfunction, and what does this imply for the status of mental disorders and brain disorders? In what follows, I shall argue that Jefferson’s contribution to this debate is (...) better understood as a conceptual explication of how psychiatrists, some philosophers, scientists and clinicians in the field (broadly construed) think of the label ‘brain disorder’. I infer this on the basis that Jefferson’s thesis would not follow from any serious, well-worked out theory of proper function. Justin Garson has recently advanced a Generalised Selected Effects Theory of biological proper function. According to Garson, his theory spells trouble for the Dysfunction Account of Disorder. This paper argues that Garson’s critique of the Dysfunction Account from the Generalised Theory fails, and that we should reject the Generalised Theory outright. I first show that the Generalised Theory does not, as Garson asserts, imply that neurally selected disorders are not dysfunctional. Rather, it implies that they are both functional and dysfunctional. I. The Metaphysics Behind the New Idealism. My remarks in this paper focus on the question of the connection between thought and the world from the perspective of recent critical discussions of the correspondence theory of truth. In some of these discussions, the notion of the world has been branded a will o’ the wisp. The plain implication of these discussions is the reintroduction of something like “objective idealism” back into the philosophical arena. For, the world is countenanced only in (...) a sense that ties it closely to a common set of beliefs, while it is rejected in the sense that would make it other than thought. There is no attempt, within the new idealism, to eliminate familiar physical objects or to insist that the set of beliefs are those of the first person. And so neither of the important characteristics of “subjective idealism” are present. (shrink)

I was an altar girl at St. Mary the Virgin, New York City–one of the first, in fact. In the mid‑70s, one of my friends approached the Rector and negotiated a deal: we women, who were interested in acolyting, would be allowed to serve at mass during the week, in street clothes, on the condition that we form and staff an altar guild.

Resource constraints in developing countries compel policy makers to ration the provision of healthcare services. This article examines one such set of Guidelines: A patient dialysing in the state sector in South Africa may not refuse renal transplantation when a kidney becomes available. Refusal of transplantation can lead to exclusion from the state-funded dialysis programme. This Guideline is legally acceptable as related to Constitutional stipulations which allow for rationing healthcare resources in South Africa. Evaluating the ethical merit of the Guideline, (...) and exploring the ethical dilemma it poses, proves a more complex task. We examine the actions of healthcare professionals as constrained by the Guideline. From a best interests framework, we argue that in these circumstances directing patient decision making is not necessarily unethical or unacceptably paternalistic. We then scrutinise the guideline itself through several different ethical ‘lenses’. Here, we argue that bioethics does not provide a definitive answer as to the moral merit of rationing dialysis under these circumstances, however it can be considered just in this context. We conclude by examining a potential pitfall of the Guideline: Unwilling transplant recipients may not comply with immunosuppressive medication, which raises questions for policies based on resource management and rationing. Part One. In our strife to express the meanings of moral terms, we have neglected the one transparently built?in meaning: ?A man ought to keep his promises? could mean ?A man owes it to other men to keep his promises. Such is his debt and duty ? just what is due or owed?. This proposal is supported by the evidence of major languages of the world, ancient and modern, in all of which identical or closely related words serve to express (...) both the idea of material debt and that of moral obligation. But on study the revealing model and analogue of ?moral debt? is found, not in debts of exchange, the simplest and most obvious class of debts, but in debts of shared responsibility. Working from such models we conclude that ?A ought to do X? means X is part of A's share in the cost of the good community, the common cause and stake of all mankind? (shrink)

This paper explores the tension in Kierkegaard’s Christian discourses between Kierkegaard’s overt emphasis on Scriptural authority and Kierkegaard’s imaginative Scriptural use, through an analysis of the discourse series, “Thoughts That Wound from Behind—for Upbuilding.” The paper argues that Kierkegaard employs Scriptural language both imaginatively to create distanciation and directly to create confrontation, without differentiating how Scriptural authority functions in these two uses. The paper concludes that when Kierkegaard emphasizes Scriptural authority, he is really emphasizing the authority of “Christian concepts” stabilized (...) in Christian tradition, and that he utilizes Scripture freely and imaginatively to challenge readers with those authoritative concepts. This paper represents an attempt to indicate the idea of a logic slightly more general than sentential calculus, which is applicable to many philosophical issues. In particular, I shall use this generalized calculus to discuss a variation of the logic of imperatives. In part I, certain general considerations about indicative calculi provide the basis, as well as indicate the need, for the more formal construction of part II. To mark International Women’s Day the Research Group for Law, Gender and Sexuality at Westminster Law School held an evening conversation on 10 March 2016 on Women and Asylum. Speakers working in different areas of the asylum system shared their insights and experiences with an audience of staff, students, activists and other visitors. Harriet Samuels chaired the conversation and the speakers were Princess Chine Onyeukwu, Debora Singer, Priya Solanki and Zoe Harper. This article is an edited extract from the (...) transcript of the presentations and wide-ranging discussion, including the question and answer session. The discussion focused on the different steps in the refugee determination process and considered, in particular, the gendering of credibility and how women’s perceived lack of credibility has a significant impact on determinations and processes. This paper argues that proper functions are proximal functions. In other words, it rejects the notion that there are distal biological functions – strictly speaking, distal functions are not functions at all, but simply beneficial effects normally associated with a trait performing its function. Once we rule out distal functions, two further positions become available: dysfunctions are simply failures of proper function, and pathological conditions are dysfunctions. Although elegant and seemingly intuitive, this simple view has had surprisingly little uptake in (...) the literature. Indeed, our position departs from that of almost every theorist who has engaged with the issue at any depth. We start by presenting three arguments for the position that proper functions are proximal: one from the specificity of functions, one from their relation to intervention, and one from their relation to pathology. We then consider two case studies evidencing the trouble that accepting distal functions causes for philosophical reflection on the nature of pathological conditions. Finally, we anticipate and respond to three objections: that there can be failure of function without dysfunction; that our account is unacceptably revisionary in respect of normal function-talk; and that our thesis over-generalises from a narrow set of cases. The following questions are discussed here. Is induction a reasonable procedure in the context of a denial of physically necessary connections? What is physical necessity? If induction does presuppose physical necessity, what amount of it is presupposed? It is argued that with logic as the only restriction on what is to count as a possible world, it is unreasonable to claim that observed connections, whether universal or statistical, will continue to hold. The concept of physical necessity is no more problematic (...) than that of logical necessity, once it is recognized that the necessity of physical and logical necessity is the same. A variant of Keynes' principle of limited independent variety answers the question of the amount of physical necessity presupposed. (shrink)

When speaking of society’s role in ethics, one tends to think of society as regimenting people through its customs. _Ethics and Social Survival_ rejects theories that treat ethics as having justification within itself and contends that ethics can have a grip on humans only if it serves their deep-seated need to live together. It takes a social-survival view of ethical life and its norms by arguing that ethics looks to society not for regimentation by customs, but rather for the viability (...) of society. Fisk traces this theme through the work of various philosophers and builds a consideration of social divisions to show how rationalists fail to realize their aim of justifying ethical norms across divisions. The book also explores the relation of power and authority to ethics—without simply dismissing them as impediments—and explains how personal values such as honesty, modesty, and self-esteem still retain ethical importance. Finally, it shows that basing ethics on avoiding social collapse helps support familiar norms of liberty, justice, and democracy, and strives to connect global and local ethics. (shrink)

This research investigates the perceptions of five constituent groups of an accredited business school — their perceptions of others'' ethics, of their own ethics and ideal values, and of how business ethics can be improved. Self-described behavior from the constituent groups is quite similar, yet is decidedly different from that which respondents felt others would do. Undergraduate business students tended to have the lowest estimation of others'' ethics in addition to the least ethical self-described behavior compared with other constituent groups. (...) All constituents were solidly in favor of improving ethics by developing principles of business ethics, requiring ethics courses in business schools and introducing industry codes of ethics. People are much more ethical than they are perceived to be. Knowing that others are more ethical may in turn cause other people to act more ethically. Similarly, believing that others are less ethical may encourage less ethical behavior. (shrink)

The focus here will be on democracy as a social good. Today people want to live in a democratic society. But why do they see this as a good? Exploring this question will lead us to a justification of democracy. I shall not be concerned primarily with justifying full or ideal democracy; for it is important to show the positive effects of even modest democratic gains. I do not think one can justify democracy in the more demanding sense of showing (...) it has consequences that any rational being would desire. So I shall be content to give what might seem merely a social, or group-based, rather than a purely rational justification of democracy. (shrink)

FlowerThe discussion which follows comprises comments on the papers by John Bodel, D. S. Potter, and Richard Talbert which were delivered at the APA/AIA seminar on the Senatus Consultum de Cn. Pisone Patre in Chicago, 28 December 1997. Those papers, now collected (with some minor revisions) in this issue of (...) AJP, cover a variety of topics ranging from Piso’s punishments to the virtues espoused and advertised in the rhetoric of the Julio-Claudians, from the chronology of events in A.D. 19–20 to the relationship between the decree and the account of Piso’s trial in Tacitus (Ann. 3.10–18). They serve to illustrate just some of the many aspects of Roman life which have been illuminated in new and vivid detail by the publication of the decree. My purpose here is to reflect upon these particular papers and to prompt further thought about a number of questions arising from the decree. Remarks below are focused closely on the meaning and interpretation of the new text itself. Rather than seeking to take a definite stance on every issue, my aim here is to explore some interpretations and to prompt further debate. Even as the Senate’s decree provides us with a wealth of fresh insights into events in Rome and in the empire in 19–20, it also reveals the limits of our knowledge and understanding about many areas of Roman life.J. Bodel, “Punishing Piso”In his detailed and well-argued paper John Bodel focuses on four of the six penalties imposed by the Senate on Cn. Calpurnius Piso after his suicide:1. The ban on mourning by women (lines 73–75)2. The ban on Piso’s imago (76–82) [End Page 99]3. The erasure of Piso’s name from the statue of Germanicus set up by the sodales Augustales in the Campus Martius near the Altar of Providentia (82–84)4. The demolition of additions built by Piso to link various private houses supra portem Fontinalem (105–8).Bodel has chosen to comment on these four penalties since they reflect Piso’s public image in Rome. A focus on specific penalties is helpful in getting to grips with the implications of the Senate’s imposition of post-mortem sanctions, commonly referred to as damnatio memoriae. However, all six of the penalties are actually part of the damnatio memoriae, and it is also important to consider them as a group. 1 As Bodel has clearly shown, they were specifically tailored to Piso’s case. They seem to be listed in an order which suggests events in sequence after a death, starting with mourning by women, moving through commemoration, and ending up with questions of property, which would, under other circumstances, have been disposed of through the will of the deceased. The property is actually divided between two generations of Piso’s descendants as provision is also made for his granddaughter Calpurnia. She was the child of his eldest son and must have been very young at the time of the trial. 2As Bodel has so perceptively emphasized, the penalties imposed on Piso reflect a tension between the desire to remember the villain, by holding him up as an example to warn others, and the desire to erase his memory, since being forgotten is integral to his punishment. This tension is further emphasized by the title of Copy A of the new decree found at Irni, which was added locally by the governor, N. Vibius Seranus. Piso’s name appears in large letters over the very decree which bans his memory. There is an essential contradiction here, but it is a contradiction which is actually typical of sanctions against memory in Roman culture. A similar contradiction is inherent in other traditional penalties not imposed on Piso, such as the celebration of the day on which the disgraced person died.
